Content Ownership and Rights

You retain all ownership rights to the recordings and content you create using Pointerful ("Your Content"). By using our Service, you grant us a limited license to:

• Store and process Your Content to provide the Service
• Display Your Content back to you
• Create backups and ensure data redundancy
• Improve our AI and processing algorithms (using anonymized data only)

Our Content

All intellectual property rights in the Service, including software, design, trademarks, and documentation, remain our exclusive property. You may not copy, modify, distribute, or reverse engineer any part of our Service.

Payment and Billing

Lifetime Plan

Our Lifetime Plan is a one-time payment that grants you permanent access to premium features. By purchasing the Lifetime Plan, you agree to:

• Pay the one-time fee as displayed at checkout
• Provide accurate payment information
• Accept that all sales are final (subject to our Refund Policy)

Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms and conditions.

Taxes

You are responsible for any applicable taxes, duties, or government charges related to your purchase.

Refunds and Cancellations

Service Availability

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINTERFUL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Pointerful and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of fees
• Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Pointerful regarding the Service.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
